Use of the site
Eligibility and access
By accessing or using jaiclubofficial.com.co (the "Site"), you confirm that you are at least 18 years of age, have the legal capacity to enter into binding agreements under Indian law, and agree to comply with these Terms of Service in full. If you do not meet these requirements, you must discontinue use of the Site immediately. Jai Club reserves the right to withdraw or amend any service, feature, or content on the Site without prior notice.
Permitted and prohibited use
You may use the Site solely for lawful, personal, non-commercial purposes. You must not transmit unsolicited promotional material, attempt unauthorised access to any server or database connected to the Site, introduce malicious code, or scrape or reproduce content without Jai Club's prior written consent. Impersonating any person or entity, misrepresenting your affiliation with Jai Club, or using the Site to facilitate fraud, including misuse of UPI payment instruments, is strictly prohibited.
Account responsibilities
Where the Site requires registration, you are solely responsible for maintaining the confidentiality of your credentials and for all activity conducted under your account. Notify Jai Club immediately of any unauthorised access or suspected security breach. Jai Club reserves the right to suspend or terminate accounts that violate these Terms, abuse promotional offers, or initiate unwarranted chargebacks, without prior notice or liability.
Intellectual property
Ownership of content
All content on the Site, including text, graphics, logos, images, audio, video, data compilations, and software, is the exclusive property of Jai Club or its licensed suppliers and is protected under the Copyright Act 1957 (India), the Trade Marks Act 1999, and applicable international intellectual property conventions. The Jai Club name, logo, and all associated marks may not be used in connection with any product or service without Jai Club's express prior written consent. Unauthorised use may attract civil and criminal liability under Indian law.
Limited licence to users
Jai Club grants you a limited, non-exclusive, non-transferable, revocable licence to access the Site for personal, non-commercial use only. This licence does not permit you to reproduce, distribute, publicly display, or create derivative works from any Site content; use automated tools such as bots or scrapers to extract data; or frame or mirror any portion of the Site without written consent. This licence terminates automatically upon any breach of these Terms.
User-submitted content
If you submit reviews, comments, or other material to the Site, you grant Jai Club a worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, adapt, publish, and distribute that content across any media. You warrant that you hold all rights necessary to grant this licence and that your submission does not infringe any third-party rights. Jai Club may remove user-submitted content at its sole discretion and without notice.
Limitation of liability
Disclaimer of warranties
The Site and all content, products, and services provided through it are offered on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Jai Club does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Site is entirely at your own risk.
Cap on liability
To the fullest extent permitted by applicable law, Jai Club, its directors, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption, arising out of or in connection with your use of, or inability to use, the Site. Jai Club's total aggregate liability for any claim under these Terms shall not exceed the amount, if any, you paid to Jai Club in the thirty (30) days immediately preceding the event giving rise to such claim.
Third-party services
The Site may link to third-party websites or integrate third-party payment processors. Jai Club is not responsible for the content, privacy practices, or reliability of any third-party service. Your use of third-party services, including UPI-based payment gateways, is subject solely to each provider's own terms and policies.
